Release Of Revised Immigration Executive Order Delayed A Week

WJ - President Donald Trump’s revised executive order on travel and refugees will be released next week, the White House indicated Wednesday.

Based on comments Trump made at a press conference last week, it was expected that a revised version of the order that was blocked by the courts would be signed this week.

White House policy adviser Stephen Miller said Tuesday night the revised order will steer a balance between what the courts have decided in the past few weeks and the goals Trump seeks to accomplish

"One of the big differences that you are going to see in the executive order is that it is going to be responsive to the judicial ruling which didn’t exist previously,” Miller said during an appearance on Fox News Channel.

"And so these are mostly minor, technical differences. Fundamentally, you are still going to have the same, basic policy outcome for the country.”

The Department of Justice, in a court filing, explained the intent of the revised order.

"Rather than continuing this litigation, the President intends in the near future to rescind the Order and replace it with a new, substantially revised Executive Order to eliminate what the panel erroneously thought were constitutional concerns,” it said in a brief to the U.S. Court of Appeals for the 9th Circuit.

"In so doing, the President will clear the way for immediately protecting the country rather than pursuing further, potentially time-consuming litigation,” the filing said.

CBS News reported the revised executive order will not apply to green card holders or individuals in transit.

However, CBS reported it will target citizens of the same seven countries with high rates of terrorism that were targeted in the initial order.

Miller still believes the appellate court rulings that blocked Trump’s initial order shortly after it was implemented were wrong.

"The rulings from those courts were flawed, erroneous and false,” he said. "The president’s actions were clearly legal and constitutional and consistent with the longstanding tradition of presidents of the past.”

Trump also noted that the revised order will adapt to the legal reality from recent decisions.

"The new order is going to be very much tailored to what I consider to be a very bad decision,” Trump said at a press conference last Thursday.
